Minogue Furniture Terms and conditions

We at Minogue Furniture want to ensure that your shopping experience with us both online and in-store is as user friendly as possible. We have set out below our terms and conditions of purchase using a list of useful headings.
 Payment

1. A 50% deposit is required on all special-order goods and a 30% deposit is required on all other goods.
2. All deposits/payments are non-refundable, credit notes will be issued where applicable.
3. All balances must be paid 7 days prior to the agreed delivery date, otherwise delivery will be postponed.

 
 Delivery

1. In stock goods must be delivered within a maximum of 4 weeks from the purchase date.
2. Floor models and discontinued goods must be delivered within a maximum of 2 weeks from the purchase date.
3. Special order and inbound goods must be delivered within 2 weeks of notification of arrival.
4. Lead times on Special Orders and inbound goods are estimated and not guaranteed. Minogue Furniture cannot accept liability for manufacturer, shipping, customs or other third-party delays but will take all reasonable efforts to meet with estimated delivery times.
5. A 5% storage charge per item per week will be incurred on goods held after our 4-week holding period has elapsed.
6. Any amendments/balances due must be made at least 7 days prior to a delivery date, or a re-delivery charge of €59 will apply – please contact [email protected]
7. Under health & safety guidelines, we will not carry out a delivery if we or any Minogue Furniture employee considers it unsafe to do so or access is denied.
8. If you require your furniture to be delivered into your house or a specific room, we are happy to do so within reason and at your own risk. Protection of access routes shall be a matter for you. Minogue Furniture or any Minogue Furniture employee cannot accept liability for any occurrence or damage that might occur to the furniture or property.
9. Delivery, disposal, storage and assembly charges may apply. With regard to goods for assembly – the room must be cleared prior to delivery to allow for safe assembly by Minogue Furniture employees.
10. Will it fit ? – Accessibility to the property and measurements of goods is the customers'’ sole responsibility.

 
 Cancellation/Returns

1. Special Orders are goods ordered to the customer’s specific requirements. There is a strict no return/refund policy on Special Orders. Your deposit will be forfeited on any orders cancelled.
2. Discontinued goods are at a reduced price as they are end of line goods that are no longer part of our current stock. There is a strict no return/refund policy on discontinued goods. Your deposit will be forfeited on any orders placed in store which are subsequently cancelled.
3. Floor models may show signs of wear and tear or have minor damage, dents, tears or soilage, etc. Please inspect carefully as they are sold as seen and are non-refundable. This does not affect your statutory rights. However, it is your responsibility to satisfy yourself that the condition of any floor model is acceptable to you.
4. If standard purchased item(s) do not fit or suit, we can issue you with a credit note, less 20% restocking charge if the item(s) are returned unused in their original packaging or a 30% restocking charge if the item(s) are not returned in their original packaging with an original receipt. Please note that mattresses, divans, pillows cannot be returned for hygiene reasons.
5. The customer is responsible for covering the cost of the returning/collecting the item(s).

 
 Collections

1. All collections must be paid for in full at time of purchase and original invoice must be presented at collection point. All such goods must be collected within a maximum of 2 weeks. Goods not collected within 2 weeks of their collection date will incur a 5% storage charge per item per week.
2. Minogue Furniture and Minogue Furniture employees accept no responsibility for any damages that may occur in circumstances where we offer assistance in loading goods into customer vehicles.
3. Goods must be inspected at point of collection and signing off is an acceptance that the goods are correct and perfect.
4. Any items which can no longer be collected or fit into your vehicle will incur a delivery charge.

 
 Damaged/Faulty Goods
Minogue Furniture will at its option: repair, replace or refund the customer with the full purchase price of goods sold and delivered which upon delivery/collection are defective. Customers must report any damage, i.e. scratches, dents, tears, soiling, etc., within 3 days of receipt to our customer care team at [email protected]
It is important that each good is carefully and thoroughly inspected by you immediately upon delivery/collection. We reserve the right to inspect goods before electing to repair, replace or refund the customer.
 
 Colour Variation

1. While every reasonable effort will be made to ensure colour matches, fabric and leather may vary due to dye lot variations. Leather and wood goods will by their nature be subjected to grain variations. All removable covers of a matching suite must be cleaned at the same time in order to avoid colour variations. Minogue Furniture will not be responsible for colour variations in the event that matching goods are not purchased together.
2. Minogue Furniture cannot guarantee continuity of supply of items purchased.

 
 Warranties

1. Minogue Furniture offer a standard 1 year manufacturer’s guarantee. Damage which results from wear and tear, accident or misuse will not be covered under manufacturer’s guarantee.
2. No warranty or change of terms and conditions expressed or implied shall be valid unless documented on this contract and approved by management of Minogue Furniture.
3. Your statutory rights of the Sale of Goods and Supply of Service Act 1980 are not affected.

 
 Ownership
The goods will remain the sole property of Minogue Furniture until payment has been received at which time the title passes to you. You will be responsible for the care of the good(s) once you have received delivery of them.
 
 General

1. Minogue furniture goods are intended for domestic use only.
2. When consented to by the customer, data will be retained for so long as is required for the purpose the customer data was collected by the Minogue Furniture Marketing Department and will be added to our database to be used for marketing purposes (including mailing lists and text messaging). We may also pass this customer data we collect to other companies within our group for administrative purposes. We may also use third parties to carry out some of these roles and other activities. We always include an “opt-out” of receiving such communications at any time. Minogue Furniture will always ensure that appropriate safeguards are in place to protect customer data.
3. Further to clauses 2(h) and 4(b) herein, to the fullest extent permitted by applicable law, under no circumstances, including but not limited to, negligence, shall we be liable to you for any direct, indirect or incidental, special or consequential damages that result from the delivery, loading or collection of good/s, any material or data sent or received or not sent or received or any of the above-mentioned damages that result from the use or inability to use the good/s. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed €200.
